GUNS / WEAPONS CRIMES
FIREARMS, CONCEALED WEAPONS, POSSESSION FOR A DANGEROUS PURPOSE
Guns and weapons offences commonly include: possession of weapon for a dangerous purpose, carrying a concealed weapon, careless storage or handling of a firearm, unauthorized possession of a firearm, possession of restricted or prohibited firearm, and weapons trafficking.
Lawful possession, storage, and transportation of firearms is governed by both the Criminal Code and the Firearms Act. Furthermore, firearms are subject to three levels of classification including: prohibited (i.e. Handguns with barrels of 105 mm length or less or sawed off shotguns), restricted (ie. Non-prohibited handguns), and non-restricted (hunting rifles and shotguns). As such, defending firearms offences can be complex and technical in nature.
Depending on the nature of the charge and the circumstances, the penalties for a weapons conviction can range from a discharge to a fine to years of incarceration. Individuals may also be prohibited from possessing weapons by way of court order.
